KCC 3223/2017

This case involved whether a Saudi citizen had the right to obtain a licence to open a medical centre. It was claimed as a GCC national he had the same rights as Kuwaitis in this respect.

Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants to dismiss a decision by which he had been deprived of obtaining a licence for opening a medical centre.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had dismissed the case on the grounds that he did not have the right to obtain the licence because he was a Saudi citizen. He said that the agreements signed between the GCC countries gave him the right to obtain the licence.
