This case had involved compensation claimed by an employee whose passport was withheld by the employer after the termination of his employment. This was still classed as a labour dispute so the court lacked jurisdiction.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay compensation of 5001 Dinars. He said that the company had failed to hand over his passport after the termination of his employment contract.

The court ruled that the company should pay the claimant the compensation.

The claimant and the company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the claimant 3000 Dinars.

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the consideration of the case did not fall under the jurisdiction of the court.
