This case involved an individual accused of cybercrime and spreading fake news about the state. The fact he had been under the influence of alcohol when the tweet was sent was irrelevant.
Background
The office of public prosecution accused a defendant to insulting the Emir of Kuwait and spreading false information about the internal situation in Kuwait by using social media. The office requested the court to penalize the defendant according to the relevant laws.
The court ruled that the defendant should be imprisoned for three years. The court also ruled that the defendant should be deported from Kuwait after the ruling execution. The court ruled that the tweets published by the defendant should be deleted.
The office and the defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should be imprisoned for five years and upheld the appealed ruling otherwise.
