KCC 28/2017
This case involved non-payment of sports person's wages. A key issue was whether disputes involving sport should first be considered by arbitration by an independent arbitration commission for sport.
Background
A claimant filed a case against some defendants before the court. He requested the court to appoint an expert in order to consider the accounts of players’ fund in order to calculate the salaries the players deserved. He requested the court to order the defendants to pay his salaries accordingly.
The court refused to accept the case because it was filed by an irrelevant party.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendants should pay the claimant 17100 Dinars.
The first defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that Article 28 of Kuwait Law No. 26/2012 stipulated that the disputes related to sporting issues should be first considered by the arbitration commission according this law.
