KCC 264/2017

This case involved an individual accused of forging documents and their sentencing. The issue of whether it was possible to appeal the criminal case was considered. The claimant was an irrelevant party as the civil element of the case had been separated from the criminal aspect.

Background

The office of public prosecution accused a defendant of forging documents in order to use them in commercial transactions. The office requested the court to penalize the defendant according to the relevant laws.

The court ruled that the defendant should be imprisoned for three years but decided to suspend the execution of the ruling if the defendant paid a guarantee of 500 Dinars until the ruling became a final one.

The defendant and the office appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The defendant appealed the ruling before the court of cassation.

The court of cassation dismissed the appealed ruling and acquitted the defendant.

The civil claimant made a reconsideration plea to the court.
