KCC 2390/2018

This case involved a refusal to grant academic equivalence to a qualification from a Chinese university. Pre-approval was not needed as this was an accredited university.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to dismiss a decision by which the Ministry of Education which had refused to approve an academic certificate he had obtained from a Chinese university.

The court ruled that the decision should be dismissed.

The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.

The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the university he had graduated from was an accredited one and that he did not need pre-approval from the Ministry of Education to study at it.
