KCC 1942/2018

This case involved a challenge to a decision to downgrade an individual's disability level. The level could not be downgraded.

Background

A claimant filed a case against a defendant before the court. He requested the court to dismiss the defendant’s decision by which his disability level had been reduced to simple one. He said that the decision was illegal.

The court ruled that the decision should be dismissed.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.

The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the relevant commission had issued a certificate in which his disability level was set at medium.

Decision

The court said that this argument was valid. The court said that the disability level of the claimant could not be amended according to Kuwait Law No. 8/2010.

The court repealed the appealed ruling.
