This case involved the cyber crime of spreading fake news on social media and threatening the prime minister. A key point was whether there was sufficient evidence.
Background
The office of public prosecution accused a defendant of spreading false information about the internal situation in Kuwait and threatening the Prime Minister using social media. The office requested the court to penalize the defendant according to the relevant laws.
The court ruled that the defendant should be imprisoned for three years and that his mobile phone should be confiscated.
The office of public prosecution and the defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and acquitted the defendant.
The office appealed the ruling before the court of cassation. The office said in their grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. The office said that the court had established the ruling based on the argument that the defendant had not intended to commit the crime by publishing his tweets although all the elements of the crime existed in his case.
