KCC 995/2016
This case initially involved the sale of property and a failure to transfer ownership. A key point was whether notification had been done in an appropriate way.
Background
A claimant filed a case against a company before the court. He requested the court to validate a sales contract he had signed with the company. He said that the company sold him two properties. He said that the company had failed to transfer the properties’ ownership to him according to the relevant procedures.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the contract should be validated.
The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the claimant had failed to inform it of the case and sent the notification to a different address. The company said that it failed to present in the court hearings as a result.
