KCC 989/2017

This case involved the sentencing of an individual accused of indecent assault and whether there was a need to treat them as a potential repeat offender.

Background

The office of public prosecution accused a defendant of indecent assault of a victim. The office requested the court to penalize the defendant according to the relevant laws.

The court ruled that the defendant should be imprisoned for five years and that he should be deported from Kuwait after the ruling execution.

The defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and suspended the announcement of the ruling on the condition that the defendant paid 200 Dinars as a guarantee and demonstrated good conduct for one year.

The office appealed the ruling before the court of cassation. The office said in its grounds of appeal that the ruling had erred in the application of law. The office said that the court had established its ruling on the grounds of the defendant’s circumstances and failed to explain these circumstances.
