KCC 96/2016
Background
The office of public prosecution accused five defendants of publishing an article which included insulting expressions against the judicial authority. The office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the defendants should pay a fine of 5000 Dinars each. The court suspended the execution of the ruling on the condition that the defendants commit to demonstrating good conduct.
The office and the defendants appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
The fifth defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the mentioned article had not included insulting expressions and it fell ithin the right of free opinion according to Article 214 of Kuwait Law No. 16/1960.
Decision
The court said that this argument was invalid. The court said that the case documents revealed that the expressions used in the article were banned according to Article 21 of Kuwait Law No. 3/2006 .
The court dismissed the appeal and upheld the appealed ruling.
