KCC 94/2016

This case involved individuals who had beaten and injured each other. A key point was the validity of the office of public prosecution appeal which had failed to detail the names of the defendants and which part of the ruling they were appealing against.

Background

The office of public prosecution accused a defendant of beating and injuring the second defendant. The office also accused the second and third defendants of beating and causing injury to the first defendant. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the first defendant should be imprisoned for three years. The court ruled that the second defendant should pay a fine of 150 Dinars and the third defendant 100 Dinars.

The first and second defendants made an objection to the ruling. The court upheld the objected ruling.

The first and second defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and acquitted the defendants.

Decision

The office of public prosecution appealed the ruling before the court of cassation.
