This case involved a claim from a partner in a shop that their partner had failed to pay their share of the shop rent. There had been a previous case which had ruled this shop was an asset of a company that belonged to the defendant.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay rent for the period from 1990 to 2016. He said that he and the defendant were partners in a shop and that the defendant was responsible for collecting the rent from the tenants. He said that the defendant had failed to pay his share of the received rent.
The court ruled that the defendant should pay the claimant 483075 Dinars.
The defendant and the claimant appealed the ruling before the court of appeal. The court dismissed the claimant’s appeal. The court amended the appealed ruling and ruled that the defendant should pay the claimant 248175 Dinars.
The claimant and the defendant appealed the ruling before the court of cassation.
