This case involved an individual accused of drug offences. A key issue was the validity of their arrest and the investigation. They had confessed and a urine sample proved evidence.
Background
The office of public prosecution accused two defendants of possessing drugs in order to take them without legal approval. The office requested the court to penalize the defendant according to the relevant laws.
The court ruled that the defendants should be imprisoned for five years each. The court ruled that the defendants should pay a fine of 1000 Dinars each. The court ruled that the drugs should be confiscated.
The first defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and acquitted the defendant from possessing the heroin and upheld the appealed ruling otherwise.
The first defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that he had maintained before the court that he was arrested and inspected without an approval from the office of public prosecution but the court dismissed this defence.
