KCC 882, 898 and 444/2017

Background

A company filed a case against another company before the court. The company requested the court to order the other company to pay 207575 Dinars as compensation. The company said that the other company had removed its products from the shelves.

The other company added another defendant to the case and requested the court to order him to pay the compensation. The company said that the defendant had ordered them to remove the company’s products from the shelves.

The court dismissed the two cases.

The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the other company should pay the company 15743.367 Dinars.

The disputed parties appealed the ruling before the court of cassation.
