KCC 881/2015
This case involved the time limit for an employee to claim their dues on termination.
Background
An employee filed a case against a company before the court. He requested the court to order the company to pay 6017.442 Dinars and pay in lieu of notice. He said that the company had dismissed him from his job and failed to pay his entitlements.
The court ruled that the company should pay the employee 5305.113 Dinars.
The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the employee did not have the right to claim the entitlements due to the statute of limitation according to Article No. 439(1) of Kuwait Decree-Law No. 67/1980.
Decision
The court said that this argument was valid. The court said that the employee did not have the right to claim the entitlements according to Article 144 of Kuwait Law No. 6/2010.
The court repealed the appealed ruling.
