KCC 874/2018

Background

The office of public prosecution accused two defendants of broadcasting a TV show in which the victim was insulted. The office also accused another defendant of participating in this crime. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the first and second defendants should pay a fine of 5000 Dinars each. The court ruled that the third defendant should be imprisoned for one year and suspended the execution of the punishment if the third defendant paid a guarantee of 5000 Dinars.

The defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and acquitted the defendants.

The office appealed the ruling before the court of cassation. The office said in its grounds of appeal that the ruling had erred in the application of law. The office said that the court had acquitted the defendants although the elements of the crime had existed in their case.
