Background

An employee filed a case against a company before the commission of labour disputes settlement. He said that he had retired from his work and that the company had failed to pay him his financial entitlements. He requested the company to pay these entitlements. The case was then referred to the court.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the employee 45306.794 Dinars.

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. The company said that the court had ordered them to pay the value of insurance subscriptions to the employee in violation to the Labour Law in Oil Industry.
