KCC 805/2016

This case involved whether police investigations which had led to an individual being convicted of firearms offences were valid.

Background

The office of public prosecution accused a defendant of possessing a firearm and ammunition without legal licence. The office requested the court to penalise the defendant according to the relevant laws.

The court ruled that the defendant should pay a fine of 1000 Dinars. The court also ruled that the firearm and the ammunition should be confiscated.

The office and the defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the execution of the ruling should be suspended on the condition that the defendant paid a guarantee of 100 Dinars and demonstrated good conduct for three years.

Decision

The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the inspection and arrest proceedings were invalid.
