KCC 790/2016

This case involved whether an employee who had breached their employment contract deserved severance pay and pay in lieu of notice.

Background

An employee filed a case against a company before the court. He requested the court to order the company to pay him his financial entitlements and a certificate of experience. He said that the court had dismissed him from his job without legal justifications and failed to pay his entitlements.

The court ruled that the company should pay the employee 24770.361 Dinars. The court also ruled that the company should provide the employee with a certificate of experience.

The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the employee did not deserve a severance payment because he had violated his employment contract.
