KCC 779/2016
This case involved a claim for compensation and entitlements by an employee who had been injured at work and had stopped working. A key point was that a Ministry of Health report provided sufficient evidence the employee had suffered a workplace injury.
Background
An employee filed a case against a company before the department of labour disputes settlement. He said that he was working for the company as a cleaner and that he got injured while working and stopped working. He said that the company had failed to pay his entitlements including compensation. He requested the company to pay these entitlements and compensation. The department referred the case to the court.
The company added another defendant to the case and requested the court to order them to pay the entitlements and compensation.
The court dismissed the two cases.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
