KCC 755/2016
This case involved whether an employee deserved pay in lieu of notice and a bonus because he had been forced to retire. A key point was he had not been forced to retire.
Background
An employee filed a case against an employer before the court. He requested the court to order the employer to pay his financial entitlements. He said that the employer had failed to pay these entitlements.
The court ruled that the employer should pay the employee 2191.427 Dinars.
The two parties appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the employer should pay the employee 17283.856 Dinars.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the employer had forced him to retire and therefore he deserved pay in lieu of notice. He said that that he had also maintained before the court that he deserved an annual bonus but the court dismissed this defence.
