KCC 741, 810/2017
This case involved payments including severance pay due to an employee who had been involved in an accident.
Background
A claimant filed a case against two defendants before the court. He requested the court to appoint an expert in order to calculate compensation he deserved because of a document about a personal accident according to Kuwait Law No. 28/1969.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendants should pay the claimant 1385 Dinars.
The claimant and the defendants appealed the ruling before the court of cassation.
Decision
Appeal No. 810/2017
The claimant said in his grounds of appeal that the ruling had erred in the application of law. He said that the experts appointed by the court had failed to calculate his severance payment.
The court said that this argument was valid. The court said that the experts had failed to include the value of severance payment in the claimant’s entitlements. The court said that the ruling violated Article 51 of Kuwait Law No. 6/2010.
The court repealed the appealed ruling.
