KCC 720/2016

This case involved theft from a victim using force. A key issue was the validity of witness evidence from the victim which it was claimed included inconsistencies.

Background

The office of public prosecution accused two defendants of stealing from a victim using force. The office requested the court to penalise the defendants according to the relevant laws.

The court ruled that the defendants should be imprisoned for five years each. The court ruled that the defendants should be deported from Kuwait after the execution of the ruling.

The first defendant made an objection to the ruling. The court upheld the objected ruling.

The first defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The first defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling has erred in the application of law. He said that the court had established the ruling on the grounds of the testimony of the victim although it included many contradictions
