KCC 710, 743/2017

This case involved compensation paid to judges who had been falsely accused of unprofessional conduct.

Background

Claimants filed a case against a defendant before the court. They requested the court to order the defendant to pay 70000 Dinar tor each of them. The claimants said that they had been working as judges and that they had rejected a case submitted by the defendant previously. They said that defendant had accused them of unprofessional conduct without legal grounds and harmed their reputation.

The court ruled that the defendant should pay 12000 Dinars to the claimants as compensation.

The claimants and the defendant appealed the ruling before the court of appeal. The court dismissed the defendant’s appeal. The court amended the appealed ruling and ruled that the defendants should pay the claimants 20000 Dinars.

The claimants and the defendant appealed the ruling before the court of cassation.

Appeal No. 710/2017

The claimants said in their grounds of appeal that the ruling had erred in the application of law. They said that the compensation the court had ordered the defendant to pay did not match the harm that had resulted from his accusations.
