Background
An employee filed a case against a company before the court. She requested the court to order the company to pay her financial entitlements. She said that she had resigned from the company and that the company had failed to pay the entitlements.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 1330.128 Dinars.
The employee appealed the ruling before the court of cassation. She said in her grounds of appeal that the ruling had erred in the application of law. She said that the court had failed to order the company to pay her leave although she deserved it
Decision
The court said that this argument was valid. The court said that the employee deserved the leave according to Article 70 of Kuwait Law No. 6/2010.
The court repealed the appealed ruling.
