KCC 694/2016
This case involved whether an employee had the right to claim severance pay when the ownership of the company they worked for was transferred.
Background
An employee filed a case against a company before the court. He requested the court to order the company to pay financial entitlements including a severance payment.
The court ruled that the company should pay the employee 20696.130 Dinars.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and refused to consider the case because it was filed before the legal timing.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had refused to consider the case on the grounds that his current job should be considered as extension of his work for the company although he had the right to claim his financial entitlements when the company’s ownership was transferred.
