This case involved the acquittal of two individual's charged with sexual offences against an underaged person. A key issue was whether the court had wrongly ignore the victim's testimony.

Background

The office of public prosecution accused a defendant of having sexual relationship with an underage person. The office also accused another defendant of indecent assault of the victim. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the defendants should be imprisoned for five years each. The court ruled that the first defendant should be deported from Kuwait after the ruling's execution.

The two defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and acquitted the defendants.

The office appealed the ruling before the court of cassation. The office said in its grounds of appeal that the ruling had erred in the application of law. The office said that the court had failed to listen to the victim’s testimony.

The court said that this argument was invalid. The court said that the court had not listened to the victim’s testimony because the existing evidence proved that the testimony was not incorrect.
