KCC 613, 615/2017

This case involved a failure to sign a maintenance contract for medical devices. A key issue was whether interest could be levied on the amount due as it was stated a date for last payment had been under a previous contract not the one involving these transactions.

Background

A claimant filed a case against a defendant before the court. He requested the court to dismiss the decision by which the defendant refused to sign the maintenance contract for medical devices he had bought them from him. He also requested the court to appoint an expert in order to consider the losses he had incurred as a result of the decision. He requested the court to order the defendant to pay him compensation accordingly.

The court ruled that the defendant should pay the claimant 866222 Dinars and legal interest of 7%.

The claimant and the defendant appealed the ruling before the court of appeal. The court dismissed the appeal made by defendant. The court amended the appealed ruling and ruled that the defendant should pay the claimant 789915 Dinars and legal interest of 7% in addition to 380508 Dinars.
