Background

An employee filed a case against a company before the court. He requested the court to order the company to pay his financial entitlements. He said that his employment contract was terminated without receiving these entitlements.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the employee 12068.059 Dinars.

The employee and the company appealed the ruling before the court of cassation.

Decision

The court considered the issues related to the general order. The court said that the case documents revealed that the ruling text lacked the names of the judges who had considered the case. The court said that even if the judges failed to attend the hearing when the ruling was announced, the ruling should be signed by the judges according to Article 112 and 116 of Kuwait Decree-Law No. 38/1980 .

The court repealed the appealed ruling.
