KCC 569/2016

This case involved an individual convicted of possessing drugs and driving under the influence of drugs. The individual received a suspended sentence. A key issue was whether it was possible to order the individual to be tested for drugs twice a month if they had a suspended sentence.

Background

The office of public prosecution accused a defendant of possessing drugs in order to take them and of driving the car under the influence of the drugs. The office requested the court to penalize the defendant according to the relevant laws.

The court suspended the issuance of the ruling on the condition that the defendant paid a guarantee of 1000 Dinars and showed good conduct. The court also issued travel ban against the defendant.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
