KCC 566/2016
This case involved individuals accused of robbery, property damage and possessing firearms. A key point was that it was not possible to include deportation in the sentencing of one of the defendants as they were a Kuwaiti citizen and this was against the constitution.
Background
The office of public prosecution accused three defendants of robbing two phones and damaging the victims’ cars and possessing firearms. The office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the first defendant should be imprisoned for five years for the first and second crime. The court ruled that the first defendant should be deported from the country after the ruling execution. The court acquitted the second and third defendants.
The first defendant and the office appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
The first defendant appealed the ruling before the court of cassation.
