KCC 561/2016

This case involved three defendants accused of stabbing and beating victims. The key issue was who could appeal. A key point was that there had been an acquittal on one of the crimes and it was not possible to appeal a minor crime. The failure to attend a ruling execution also impacted the right to appeal.

Background

The office of public prosecution accused three defendants of stabbing and beating two victims. The office requested the court to penalize the defendants according to the relevant laws. 

The first victim filed a case against the three defendants before the court. He requested the court to order the defendants to pay temporary compensation of 5001 Dinars.

The court acquitted the first and second defendants from the first crime. The court ruled that the third defendant should be imprisoned for five years. The court ruled that the defendant should be deported after the ruling execution. The court ruled that the first and second defendants should be imprisoned for one year for committing the second crime and that they should pay a guarantee of 300 Dinars in order for the ruling to be suspended. The court referred the civil case to the relevant court.
