KCC 529/2016

This case involved a request to dismiss an investment contract and obtain compensation. A key issue was whether notice was required before dismissing the contract. However, the filing of the case was considered to be notice.

Background

A company filed a case against another company before the court. The company requested the court to dismiss the contract signed between the two parties. The company also requested the court to order the other company to pay all the interests in addition to compensation. The company said that they had signed investment contract with the other company but the latter had failed to commit to its obligations.

The court ruled that the contract should be dismissed. The court also ruled that the other company should pay all the amounts.

The other company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
