KCC 528/2015

This case involved whether there were grounds for accusing defendants of weapons offences.

Background

The office of public prosecution accused four defendants of possessing and using firearms and ammunition. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the first three defendants should pay a fine of 1000 Dinars each. The court acquitted the fourth defendant.

The three defendants and the office appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.

The defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling haderred in the application of law. They said that the elements of the crime had not existed in their case.

Decision

The court said that this argument was invalid. The court said that the case documents revealed that the court had considered all aspects of the case properly and established the ruling on the grounds of solid evidence. The court said that the elements of the crime had existed in the defendants’ case according to Article No. 3(1), 4, 2(2) of Kuwait Law No. 13/1991.
