KCC 419/2017 issued on 19/03/2018

This case involved an individual accused of a range of crimes against a person. A key point was in sentencing two of the crimes should have been considered as related to the others.

Background

The office of public prosecution accused a defendant of indecent assault, beating, detaining and insulting a victim in addition to other crimes. The office requested the court to penalise the defendant according to the relevant laws.

The court ruled that the defendant should be imprisoned for ten years for the first and second and the fourth crimes. The court also ruled that the defendant should be imprisoned for one year for the fifth and sixth crimes.

The defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should be imprisoned for five years for the first, second and fourth crimes and upheld the appealed ruling otherwise.

The defendant appealed the ruling before the court of cassation.
