KCC 409/2017

This case involved the addition of time spent training to an employee's service period for calculating his dues on retirement. A key issue was whether he had an appropriate rank to receive this award.

Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendant to add the period he had spent in the military college to his career period. He requested the court to order the defendants to pay him his entitlements accordingly.

The court ruled that the first defendant should add the studying period the claimant had spent in the military college to his career period.

The claimant and the defendants appealed the ruling before the court of appeal. The court dismissed the defendants’ appeal. The court amended the appealed ruling and ruled that the defendants should pay the claimant the award as well.
