KCC 359/2017
This case involved individuals accused of a drug offence and driving under the influence of drugs. A key issue was whether their arrest had been valid.
Background
The office of public prosecution accused two persons of possessing drugs in order to take them without legal approval and accused the first defendant of driving a car under the influence of drugs. Th office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the defendants should be imprisoned for five years each and t they should pay a fine of 5000 Dinars. The court also ruled that the driving licence of the first defendant should be cancelled.
The defendants objected the ruling. The court amended the ruling which had been objected to and ruled that the defendants could instead pay a guarantee of 1000 Dinars each and commit to having good conduct for two years.
The office and the defendants appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
