KCC 331/2017

This case involved individuals accused of taking and trading in drugs as well as driving under the influence of drugs. A key issue was whether there was sufficient evidence of the crimes.

Background

The office of public prosecution accused two defendants of possessing drugs in order to trade and to take. The office accused the first defendant of driving his car under the influence of drugs.

The court acquitted the second defendant. The court ruled that the first defendant should be imprisoned for seven years and that he should pay a fine of 10000 Dinars. The court ruled that the driving licence of the first defendant should be revoked for one year and that he should be deported from the country after the ruling's execution.

The office and the first defendant appealed the ruling before the court of appeal. The court dismissed the office’s appeal. The court amended the appealed ruling and ruled that the first defendant should be imprisoned for five years and that he should pay a fine of 5000 Dinars. The court upheld the appealed ruling otherwise.
