Background

An employee filed a case against an employer before the court. He requested the court to order the employer to pay him 6770.530 Dinars. He said that the employer had deducted money from his salary on the grounds that he had resigned from his job although he had not done so.

The court ruled that the employer should pay the employee the amount.

The employer appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The employer appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that according to the Decision No. 391, the beneficiary of a social allowance should provide the employer with a proof that he deserved this allowance before the end of the financial year. He said that the employee had failed to do so.
