KCC 24/2016

This case involved individuals accused of drug offences and their sentencing. A key question was the validity of the arrest of one of the accused.

Background

The office of public prosecution accused a first defendant of possessing drugs in order to take them. The office accused the second and third defendants of possessing drugs in order to take them. The office accused the defendants of smuggling the drugs to the prison. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the first defendant should be imprisoned for ten years and that he should pay a fine of 5000 Dinars. The court suspended the announcement of the ruling against the second and third defendants on the condition that they pay a guarantee of 200 Dinars each and show good conduct for one year. The court acquitted the defendant of the smuggling crime.

The second and third defendants and the office appealed the ruling before the court of appeal. The court upheld the appealed ruling.
