KCC 241, 329/2017
This case involved the entitlements of an employee. A key point was that the expert had not calculated the employee's entitlements according to the labour law.
Background
An employee filed a case against a company before the court. He requested the court to order the company to pay his financial entitlements.
The court ruled that the company should pay the employee 59942 Dinars.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the company should pay the employee 13865 Dinars.
The company and the employee appealed the ruling before the court of cassation.
Decision
Appeal No. 241/2017
The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the expert had miscalculated the entitlements of the employee.
The court said that this argument was valid. The court said that the case documents revealed that the expert had miscalculated the employee’s entitlements and violated Article 51 of Kuwait Law No. 6/2010.
The court repealed the appealed ruling and dismissed the case.
Appeal No. 329/2017
The court said that the dispute has already been settled because the ruling has been repealed.
