This case involved whether an individual should have had his time at military college added to his service.

Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants to add his studying period in the military college to his career period. He said that he deserved two-year award according to Kuwait Decision No. 495/2008.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendants should add the study period in the military college to the claimant’s career period.

The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had established the ruling on the grounds that the rules of Kuwait Decision No. 495/2008 should not be applied on his case, although the increase of award stipulated by the decision had not differentiated between the different military ranks.
