KCC 23, 10/2017
This case involved money deducted from an employee's severance pay. A key issue was the expert report had failed to consider the money paid to the employee.
Background
An employee filed a case against a company before the court. He requested the court to order the company to pay an amount of money they had deducted from his severance payment.
The court ruled that the company should pay the employee 74167 Dinars.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 35594.4 Dinars.
The employee and the company appealed the ruling before the court of cassation.
Decision
Appeal No. 23/2017;
The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that they had maintained before the court that they had already paid the employee the full value of their severance payment.
The court said that this argument was valid. The court said that the case documents revealed that the expert report had failed to consider the amounts of money the company had paid to the employee.
The court repealed the appealed ruling.
