KCC 2387/2016
The original case involved a claim for compensation from an insurance company by the daughter of a man who had died in a car accident. The driver was later added to the litigation by the insurance company. A key issue was whether the driver could appeal the elementary ruling as he had not been party to that case.
Background
A claimant filed a case against an insurance company before the court. She requested the court to order the company to pay her compensation of 10000 Dinars. She said that her father had died in a car accident and that the car involved in the accident was insured by the company at the time. She said that a criminal ruling had been already issued against the driver.
The insurance company requested the court to add the driver as a party to the case. The company requested the court to order the driver to pay the compensation.
The court ruled that the company should pay the claimant the compensation. The court also ruled that the driver should pay the compensation to the company.
The driver appealed the ruling before the court of appeal. The court dismissed the appeal.
