This case involved whether disability allowance should be backdated to prior the period when the application was made for the benefit.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay a monthly allowance for his disabled daughter for the period from 02/12/2013 to 20/01/2016. He said that his daughter met the legal requirements for receiving the allowance.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the institution the defendant represented paid the monthly allowance starting from the date in which the relevant commission validated the disability case and did not pay the allowance for the previous period.
