KCC 2164, 2165/2017

The original dispute involved compensation sought by heirs of a man who had been killed at an air show. Key issues included the validity of appeal documentation and the validity of the ruling as it had not been signed by the relevant judges.

Background

The heirs of a deceased man filed a case against two pilots and the Ministry of Defence before the court. They requested the defendants to pay them blood money of 1000 Dinars in addition to 203719 for material compensation and 300000 Dinars for moral compensation. They said that the pilots had caused death of their father during an air show.

The court ruled that the defendants should pay the heirs blood money of 10000 Dinars in addition to 205719 for material compensation and 50000 Dinars for moral compensation.

The heirs and the defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The defendants appealed the ruling before the court of cassation.
