KCC 1961/2016

This case involved whether a ruling was ambiguous and if it had failed to determine moral compensation.

Background

Two claimants requested the court to explain its ruling on moral compensation. They said that they had filed a case against a company and requested the court to order it to pay 150000 Dinars as compensation. They said that the court had ordered the company to pay the amount but had failed to determine the value of the moral compensation.

The court dismissed the claimants’ request.

The request was then presented to the court of cassation.

Decision

The court of cassation said that Article 125 of the Advocacy Law determined the cases in which a ruling can be explained including the ambiguity of the ruling. The court said that the case documents revealed that the court had determined that the moral compensation should be 26000 Dinars. The court said that therefore, the ruling was not ambiguous.

The court dismissed the request.
