Background
A claimant filed a case against a defendant and other defendants before the court. She requested the court to validate her right to obtain an ownership deed for a disputed property she owned along with the first defendant. She said that the first defendant was her husband and that he had failed to proceed with the procedures to issue the ownership deed to her.
The court ruled that the claimant had the right to obtain the ownership deed for the disputed property.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that he had already divorced from the claimant and therefore she did not have the right to own the property alongside him.
