KCC 1554, 1561/2017
This case involved the calculation of severance pay for an employee whose employment had been terminated and who had liability for the payment.
Background
An employee filed a case against a company before the court. She requested the court to order the company to pay her financial entitlements including severance pay. She said that the company had dismissed her from her job without notice. She added another defendant to the case and requested the court to order them to pay the amounts along with the company.
The court dismissed the case against the second defendant. The court ruled that the company should pay the employee 2323.5 Dinars.
The employee and the company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 2002.6 Dinars.
The employee and the company appealed the ruling before the court of cassation.
Decision
The court said that the case documents had revealed that the board of judges which considered the hearing was different from the one that had announced the ruling. The court said that the case documents also revealed that the court had failed to calculate the employee’s entitlements properly.
